1. Acceptance
By using the Souk Al-Benaa website or app, you agree to these terms together with our Privacy, Returns, and Shipping policies. Use of the service is governed by the laws of the State of Kuwait, including Consumer Protection Law No. 39 of 2014 and Electronic Transactions Law No. 20 of 2014.
2. Accounts
You must be at least 18 years old to create an account. You are responsible for keeping your login credentials confidential and for all activity carried out through your account.
3. Products & pricing
We make every effort to display products, prices, and specifications accurately. Prices are in Kuwaiti Dinar (KWD) and include tax where applicable. We reserve the right to correct errors, update information, or cancel orders resulting from obvious mistakes.
4. Orders & payment
Your order is confirmed when an order number is issued. We accept debit and credit cards (K-NET, Visa, Mastercard, Apple Pay, Google Pay) via the Hesabe gateway, or Cash on Delivery within Kuwait. We do not store any card details on our servers.
5. Shipping & delivery
Delivery details, fees, and timing are published on our Shipping & Delivery page and form part of these terms.
6. Returns & refunds
All returns are subject to our published Returns & Refund Policy, which is aligned with Kuwait's Consumer Protection Law.
7. User conduct
You may not use the service in any way that breaks the law, impersonates others, attempts to compromise our systems, or scrapes data without permission.
8. Intellectual property
All content (text, images, logos, designs) belongs to Souk Al-Benaa or its partners and is protected by intellectual property laws. It may not be used without written permission.
9. Limitation of liability
To the extent permitted by Kuwaiti law, Souk Al-Benaa is not liable for any indirect or consequential damages. Nothing in this clause limits any statutory consumer rights.
10. Changes to these terms
We may update these terms from time to time. Updates are posted on this page along with a new last-updated date. Continued use of the service constitutes acceptance of the updated terms.
11. Governing law
These terms are governed by the laws of the State of Kuwait, and the courts of Kuwait have exclusive jurisdiction over any dispute arising under them.
